These Terms and Conditions of Use (“Terms”) govern the use of Docketor Software (“Software”), which provides access to a confidential database containing the list of various Intellectual Property Filings, enabling attorneys to identify and respond to infringing marks. By accessing or using the Software, you agree to comply with and be bound by these Terms.


1. Intellectual Property Rights

1.1. Ownership: All intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents in and related to the Software and its underlying technology, databases, methods, flows, etc. whatsoever are owned exclusively by Docketor.

1.2. License: Subject to these Terms, Docketor grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for its intended purpose of accessing the limited database as per your subscription.

2. Confidentiality

2.1. Confidential Information: You agree to maintain the confidentiality of any non-public information obtained through the Software including the databases.

3. Use of the Software

3.1. Permitted Use: The Software may only be used to identify and address potential trademark and copyright infringements within the scope of your legal practice.

3.2. Compliance: You agree to use the Software in compliance with all applicable laws and regulations.


4. Termination

4.1. Breach of Terms: Docketor reserves the right to suspend or terminate your access to the Software if you violate any provision of these Terms.

4.2. Effect of Termination: Upon termination, you must cease all use of the Software and destroy any data obtained through its use.


5. Limitation of Liability

5.1. No Warranty: The Software is provided “as is” without any warranties, express or implied.

5.2. Liability Cap: To the maximum extent permitted by law, Docketor’s liability arising out of or related to these Terms will not exceed the fees paid by you for the Software in the twelve months preceding the event giving rise to the claim.


6. General Provisions

6.1. Governing Law: These Terms are governed by the laws of India.

6.2. Amendments: Docketor may update these Terms from time to time. Continued use of the Software constitutes acceptance of any modified Terms.

6.3. Entire Agreement: These Terms constitute the entire agreement between you and Docketor regarding the use of the Software.
